What does it mean if the Court sets a sale date of my home?

If you have a foreclosure sale date, it means you have exhausted all the time and legal strategies you had at our disposal and that the court has now ordered your home to be placed for sale at auction.

Can I do anything to delay the foreclosure sale date?

At times, with some negotiation, you may ask for a delay based on a valid contract for the purchase of your home which satisfies the judgment. This is a last ditch effort that may yield returns.  We have done this on many occasions on behalf of homeowners, even as far as having the sale of the home vacated (reversed) so that the homeowner could sell and pay off the mortgage and avoid further deficiency judgments.

What about my credit?

Yup, it does not look good at this point.  Nobody wants ten years of bad credit which may keep you from leasing a car to get around, renting an apartment, and certainly purchasing a new home during that time.  Your best bet is to do a pre short sale sale or even a short sale agreement before letting it get to actual foreclosure.

Can I get my attorney to fight the foreclosure?

Of course.  You can pay a monthly fee to the attorney till the case goes to court, but the evidence must show that you made scheduled payments without delay.  If you haven’t paid your mortgage, it goes to follow that you will lose your home unless you have negotiated with your bank or lender.
